Governing Law

The French law 2003-8 of January 3, 2003, modified and completed by the law 2004-803 of August 9 , 2004 transposes, among others, provisions related to storage facilities access set forth by the European Directive 2003/55/EC regarding common rules for domestic market in natural gas and abrogating the Directive 98/30/EC.

As a storage operator, the Major Infrastructures Division of GDF SUEZ provides access to its underground natural gas storage facilities.

Pursuant to the decree 2004-555 of June 15, 2004 provided for by the law 2003-8, the Major Infrastructures Division of GDF SUEZ has published a draft of Technical Prescriptions applicable to storage facilities.

Pursuant to the French law 2003-8 of January 3, 2003, modified and completed by the law 2004-803 of August 9, 2004, the decree n° 2006-1034 dated August 21, 2006 organises access to natural gas underground storage facilities :

  • Article 3, organises in particular, the allocation of storage capacities to suppliers with an effective final customers' portfolio, on the basis of the provisions of the ministerial decree dated February 8, 2008 relative to storage profiles and unit rights (only available in French).

  • Article 8 specifies that any supplier may reserve, possibly above its storage rights, capacities corresponding to non exercised rights which are still available; such capacities being called returnable capacities.

  • Article 14 disposes that, after satisfaction of priory needs stipulated in article 3, excess storage capacity is made available to the market under transparent and non discriminatory conditions

Storage capacities needed by the TSO to provide efficient network access

In accordance with the disposals of the European Directive 2003/55/EC of 26 June 2003 and article 30 of the law 2003-8 of 3 January 2003 modified by the law 2004-803 of 9 August 2004, GRTgaz has, from 1 April 2005 onwards, a specific flexibility and safety contract giving them access to the storage capacities needed in order to fulfil its public service obligations.

Confidential Information

Major Infrastructures Division of GDF SUEZ will ensure confidentiality of any information provided by a gas supplier requesting a storage service when preparing and/or executing a Storage Service Agreement. Such information shall not be disclosed to other gas suppliers or to GDF SUEZ entities or subsidiaries responsible for gas sales.
